Plan to shorten the 3-year term of the gift exemption for owner-occupied home

The contours of the approach to phase out this gift exemption for own home of € 106,671 are slowly but surely crystallizing.

In the Tripost of April 2022 we already reported about the abolition of this so-called 'jubelton'. In 2023, the exemption will be reduced to the amount of the increased exemption for one calendar year for gifts from parents to their children that are not subject to spending conditions (in 2022: € 27,231).

There were still some uncertainties, such as what the abolition means for the possibility of spreading the gift exemption over three years: the part of the exemption that was not used in the first year can still be used in the following two years.

The State Secretary recently indicated how he plans to phase out the spreading option. This spreading option is being phased out:

• If the first donation was made in 2021, it can still be spread over three years. So the last part can be donated by 2023 at the latest.
• If the first donation is made this year, in 2022, the spreading option is limited to two years. In concrete terms, the latter means that a part of the exemption of €106,671 that has not been used for a donation in 2022 can still be used for a donation in 2023, but no longer for a donation in 2024.
• In 2023, the high donation will already be reduced. And then the spreading option also expires.

Because the spreading option will also be tackled now, 2023 is really the last year that it can still be partly used. If the money is not yet available, or there is no home yet, then donate at least € 1 this year using the gift exemption, so that the rest can be donated next year.
