The Tax Office has announced that it is temporarily suspending the processing of final assessments for 2021 and 2022 relating to box 3 income. This specifically concerns assessments where the box 3 income consists of more than just bank deposits, such as income from shares or real estate. In addition, the processing of objections regarding box 3 income for the years 2017 through 2021 will also be suspended.
The reason for this suspension is due to several cassation proceedings currently pending before the Supreme Court. The central issue in these proceedings is whether the restoration of rights in box 3 is sufficiently in line with the Christmas ruling. The Ministry of Finance has decided to hold the processing of assessments and appeals until the Supreme Court provides more clarity.
The outcome of these cassation proceedings may be of great importance for the determination of assessments with box 3 income and for the outcome of objection proceedings against these assessments. As a result, the Supreme Court's decision may have a significant impact on both taxpayers and the Tax Administration. Pending these rulings, the Ministry of Finance has chosen to temporarily halt the processing of both final assessments and notices of objection, in order to prevent incorrect decisions based on the current situation.
